RENTAL AGREEMENT AND LIABILITY WAIVER

This Agreement is between you, the “Client” and Reynoso & Duval LLC DBA Enjoy Stroller Rental, “Enjoy”. Enjoy remains the sole owner of all of its equipment rental. Enjoy is not offering for sale, and the Customer is not buying the team. The customer hereby acknowledges that the equipment will be for personal use only. By signing and accepting the terms and conditions of this rental agreement, the Customer acknowledges that it has read, understood and agreed to the terms set forth below.

 

Reservations and payment of rental fees

Booking the Client is attached hereto and incorporated by reference.

Payment must be made by credit card, debit card or PayPal at the time of booking or in cash at the time of the delivery person. The Client agrees to allow you Enjoy make modifications, adjustments, and additions to the form of payment in order to credit, refund and charge any service fees associated with your booking.

Enjoy will confirm your reservation by email, text message or phone call within 48 hours. Clients must communicate with Enjoy if you do not receive confirmation within 48 hours subsequent to the completion of a reservation online or by phone. The colors of the products may vary from the images shown.

 

Delivery, Possession and Use

At the time of the booking, the Client shall specify the name and address of the resort, hotel or apartment/vacation home where they will be delivered and removed the rental items. The client understands that the locations and the procedures for collection of delivery/returns may vary according to the chosen location. The exact time of both the delivery and collection will be communicated via e-mail, text message or whatsapp to the client. If the client is not sure of the location of the delivery or pick-up, the customer agrees to get in touch with Enjoy to lighten it. The Customer understands that the delivery and removal based on addresses within the area of 15 miles of Walt Disney World. Addresses outside of this radius are not serviced by Enjoy, however, you will be able to coordinate a meeting point suggested by the company.

The Client understands that Enjoy only carries out deliveries and withdrawals at the entry to the following Disney parks: Animal Kingdom, Hollywood Studios and Epcot, and the delivery or withdrawal at Theme Parks will be in the usual hours of delivery/collection and has a value of $10 per service.

The Customer agrees to get in touch with Enjoy within 5 hours before the date and time of collection agreed by phone, text message, whatsapp or e-mail address if the Customer can not receive/deliver the items of rent on the place and time agreed.

The Client agrees to select a time slot for the delivery and collection: 

  • The Client agrees to be available within the time slot chosen to meet with a representative of Enjoy in person if paid in cash.
  • If the Client is housed in a hotel and paid in advance with a credit card, it is not necessary to meet in person, the representative of the Enjoy might be able to leave the article rented at reception prior to your arrival. Similarly, prior notice to you to Enjoy, at the time of the refund, the Customer may leave the article you rented at the hotel reception or in the sector of Strollers and then you will be picked up by the company. In this case, the Customer agrees to send a picture of where it has been left.
  • If the Client is hosted on a house or a holiday apartment accepts to meet in person with the representative of Enjoy, both for the delivery as for the withdrawal of the product rented, regardless of the form in which payment has been made.

The Client also agrees and understands that only the times listed on the web site at www.enjoystrollerrental.com are available for the places of delivery/pick-elected, and that at other times are not available unless you make exceptions and specific arrangements through Enjoy Stroller Rental by e-mail.

The Client accepts and understands that any request for amendment of the existing reservation must be made at least 24 hours in advance at the time of delivery agreed in the booking. Change requests made with less than 24 hours before the time agreed delivery will be fulfilled at the discretion of Enjoy.

The Client agrees and understands that all deliveries are made with great effort at the time of delivery requested, but due to the traffic or the volume, the Client understands that Enjoy to be delivered within the time slot of an hour, that the Client has chosen at the time of booking. The Client understands and agrees that, during times of extreme weather, deliveries and/or pickups can be temporarily suspended for the safety of the delivery staff up to management to consider it safe to continue with the operations (the extreme weather conditions may include, among others, the following: tropical Storms/hurricanes, tornado warnings, winds exceeding 25 mph).

The Customer accepts that if there is no contact within 24-hours prior to the agreed delivery date, the Customer accepts the possession of the rental items and their responsibilities during the possession.

The representative of Enjoy will notify the Customer via text message, whatsapp or email when you're on the way to the meeting place, estimating your arrival time. Once you have arrived at the destination, the representative of Enjoy will be notified to the Customer by the same means which is located at the entrance to the Lobby, in the case of a hotel, or at the entrance of the house/apartment vacation. The representative of Enjoy will have a tolerance of 15 minutesotherwise you should leave to avoid delays in deliveries/removals. In this case, the Customer will be charged a Fee of $30 for lateness. 

If attempts to deliver the rental items in a vacation home, and the Client is not available or the Customer has provided the location of the incorrect delivery, resulting in a second trip to re-deliver, there will be a reshipping fee of $30.

The Client agrees that it has done everything possible to verify that the locations of delivery and return desired are within the area of indicated delivery, and Enjoy providing service to this location (as indicated in the section of frequently asked questions in www.enjoystrollerrental.com). 

The Client accepts that any reserve may be modified or terminated at any time at the discretion of Enjoy if the desired location is not found in the area of delivery as indicated. The Client understands that any rental item is returned to a location outside the area of delivery indicated can incur a $100 fee at the sole discretion of Enjoy. If the client has traveled out of the area of delivery/collection and may not be returned, it is the responsibility of the customer to ensure that all the rental items and items associated with your rental item is returned to Enjoy on the return date original by taxi, services, shared ride, courier or shipping charge (FedEx, UPS, USPS, etc). All fees for such return shall be the sole responsibility of the customer.

The Client accepts that any reserve may be modified or terminated at the discretion of Enjoy if you Enjoy it considers that the health and safety standards of the hotel, resort or vacation homes desired (place of delivery or pickup) are harmful to the nature of our business.

Customer agrees to maintain possession of the rental item during the course of your rental period. The rental items should be kept secure when not in use (i.e., hotel room, vehicle). During the rental period, the items must not be left in the reception room or luggage for daily storage, unless the request of the hotel, in that case, the Customer undertakes to inform you to Enjoy. The items found in the lobby or rooms of baggage may be considered abandoned or returned ahead of time and are subject to be picked up.

The Customer agrees to report immediately to Enjoy from any defect or malfunction of the article rented during use. Once notified, Enjoy will do everything possible to solve the problem in a timely manner.

The Customer undertakes to use the rental item only for the purpose for which it was designed. At no time should exceed the weight limits established for the rental items.

The Client agrees that violations of this agreement may result in termination of rental. Enjoy reserves the right to terminate a lease on the basis of the evidence of abuse or violation of any and all parts of this agreement. The customer agrees to deliver to each and all of the accessories and equipment rented to Enjoy at the request of Enjoy. 

The Customer agrees that, upon request of the customer, any change to the stroller due to (but not limited to): buggy stopped in the rain, vomiting, child, diaper, dripping, or other body fluid, you may charge a fee in exchange for $50 at the discretion of Enjoy.

In addition, will be charged a fine of up to $100 for extreme dirtiness as it can be (but not limited to): vomiting child, diaper, dripping, or other body fluid, food remains that destroy the fabric of the stroller, excess glitter/glitter/makeup that hinder the cleaning of the future from the cloth of the item rented. 

 

To return the item rented

Resort or hotel that doesn'T belong to Disney: It is the responsibility of the Customer to ensure that all the rental items are available to be picked up at the resort or hotel in the date and time specified in the booking. Notice to Enjoy, all rental items can be returned in person to the representative of Enjoy or left at the hotel reception or sector strollers of resort, pre-sent photo to Enjoy, for the company to locate the item at the time of pick-up. At no time should you leave any rental item in the room of the guests after the check-out. The rental items left in the rooms will incur a retrieval fee of $30. The client is 100% responsible for that the items are available in the sector of strollers or at the front desk to pick them up. 

House or Apartment vacation rental:

If the Client is hosted in house or vacation apartment is the responsibility of the Customer to be available at the place and time agreed for the collection of return. The Client agrees and understands that the withdrawal must be done face-to-face with a representative of Enjoy.  Therefore, the Customer agrees to be available within the time period selected to return it in person to the representative of Enjoy in the address where you're staying and that he has given previously to Enjoy the residence of withdrawal of the item rented. The customer agrees to get in touch with Enjoy in the event that the rental items are returned prior to the return date agreed to arrange a new time of withdrawal in person.

Resorts property of Disney:

It is the responsibility of the Customer to ensure that all the rental items are available to be picked up at the resort or hotel in the date and time specified in the booking. Notice to Enjoy, all rental items can be returned in person to the representative of Enjoy or left at the hotel reception or sector strollers of resort, pre-sent photo to Enjoy, for the company to locate the item at the time of pick-up. At no time should you leave any rental item in the room of the guests after the check-out. The rental items left in the rooms will incur a retrieval fee of $30. The client is 100% responsible for that the items are available in the sector of strollers or at the front desk to pick them up. 

The customer agrees to get in touch with Enjoy in case of delay in the return of the rental items at the agreed time. It is at the sole discretion of Enjoy if you can grant a grace period. 

You can apply a flat rate of $30 for return trips to pick up rental items if they are not returned within the time agreed upon as indicated in the booking and / or rental is agreed previously with Enjoy.

If the Customer does not deliver the product to you rented without giving notice to Enjoy will be charged a Fee of $100 for each day of delay, up to the amount equivalent to the value of the product rented. 

 

Extension of the rental period

If the Customer wishes to extend the rental period, the Customer must contact Enjoy before the time of return agreed upon. Enjoy may, at its own discretion, to allow or deny any extension. Enjoy reserves the right to charge the card of the Client and the Client agrees to allow the charge of $10 for each additional day or fraction of a day that the Customer retains the rental items.

 

Exchange of items because of size or transportation

Customers may request an exchange of product for reasons of size or transportation. These applications are solely at the discretion of Enjoy in function of the availability of the product. Such requests are subject to a fee of $10 per article.

 

Deliveries and Withdrawals in Places or have Special Times

The Client understands that Enjoy only carries out deliveries and withdrawals at the entry to the following Disney parks: Animal Kingdom, Hollywood Studios, and Epcot. The client acknowledges and accepts that in case of choosing delivery or withdrawals in any one of these Disney parks will be charged an additional Fee of $10 (delivery) and/or $10 (retirement). 

The Client understands and accepts that Enjoy not performed deliveries or withdrawals in other theme parks or at the Airport in Orlando.

The delivery and / or withdrawals that are made outside of the normal hours of care to Enjoy that are published in www.enjoystrollerrental.com shall be subject to confirmation of Enjoy and if accepted will have a additional value of $10.

 

Damage or Loss of the Equipment

The Client will accept for use, as is, the rental items listed in the reservation, and accept full responsibility for the care of the equipment while it is in the possession of the Customer.

The Customer is responsible to pay the full value of the replacement of any items rented under this Agreement that is not returned to Enjoy within 48 hours of the end of the agreement. The only exception will be that has been made between the Hotel and the Customer is an extension of the rental period. 

The Customer also agrees to authorise the replacement cost of each item of rent to the credit card that you have provided to Enjoy through their registration in the website www.enjoystrollerrental.comin case you do not return the rental items. In the case of recover items after it has been charged to the customer, we will issue a full refund for the replacement charge to the customer.

The Customer is responsible for paying the cost of replacement of any part or accessory lost, either paid or provided free of charge. These include, but are not limited to: harnesses, protective against the rain, wheels, hoods, storage baskets, cup holders, trays, front, storage locations plastics, etc

The Customer is responsible for the loss, theft, damage or destruction of the rental items, and agree to pay the full replacement value of the rental items to the market value at the time of its replacement. The Customer also agrees to authorise the replacement cost of the rental items to the credit card that you have provided to Enjoy.

The Customer agrees to return the rental items in the same conditions in which they were delivered and report immediately to Enjoy for any loss, theft, damage or destruction of the rental items.

 

Cancellation of Booking

We will receive a full refund for all cancellations made 48 hours or before the date of rental. All cancellations made within the window of 48 hours will be charged the minimum rate of rent of $40 for any single stroller and $50 for any double stroller. Refunds for bookings made more than 120 days from the date of cancellation will be refunded through PayPal.

 

Disclaimer

By accepting and using the rental equipment, the Customer and any user acknowledges that the rental equipment is used at your own risk. Enjoy hereby provides no warranty with respect to rental equipment, and Enjoy specifically disclaims all warranties, either express or implied.

Enjoy and their employees, owners and affiliates will not be responsible for accident, injury or damage caused directly or indirectly by the use, misuse, or use of the rental equipment.

The Client and any user agree to hold harmless from liability to Enjoy and its employees, owners, and affiliates, from any and all liability, injury, death, property loss or damages that may result direct or indirectly from the use of the rental equipment.

 

This Agreement is governed by the laws of the State of Florida.
