RENTAL AGREEMENT AND LIABILITY WAIVER


This Agreement is between you, the "Client", and Reynoso & Duval LLC DBA Enjoy Stroller Rental, "Enjoy". Enjoy remains the sole owner of all rental equipment. Enjoy is not offering the equipment for sale, and the Client is not purchasing it. The Client hereby acknowledges that the equipment is for personal use only. By signing and accepting the terms and conditions of this rental agreement, the Client acknowledges having read, understood, and accepted the terms set forth below.

 

Reservations and payment of rental fees

All reservations are made through the website www.enjoystrollerrental.com. To do so, the client must enter: name of lodging plus delivery address, name of lodging plus pick-up address, delivery time window, and pick-up time window.
We accept reservations at least 24 hours in advance; otherwise, the client may check with Enjoy for stock and service availability. “Service” refers to the delivery and pick-up of rented items.
Payment must be made by credit/debit card via a payment link sent to the client once the reservation is completed. Payment must be completed no later than the moment of delivery if in-person. If not in-person, payment must be completed by the day prior to the delivery date.
The client will automatically receive a confirmation email after completing the reservation. The reservation will only be considered completed once the client receives the Order Number; otherwise, the reservation is not valid. Product colors may vary from those shown in pictures.

Delivery, Possession and Use

The Client understands that delivery and pickup are based on addresses within a 15-mile radius of Walt Disney World. Addresses outside this radius are not serviced by Enjoy. However, a meeting point may be arranged by the company.
The Client understands that Enjoy only delivers and picks up at the lodging entered in the reservation. Deliveries and pickups are not made at other locations.
The Client agrees to verify that the lodging name and/or delivery and pickup addresses are correct. If the Enjoy representative goes to the address listed in the reservation and it is incorrect, a $30 fee will be charged for the failed attempt. The representative may proceed to the correct address only if the schedule allows. Correctly submitted reservations take scheduling priority.
Our service hours are between 7:00 a.m. and 7:00 p.m., with one-hour time slots.
The Client understands that delivery/pickup will be made within the selected one-hour time slot. The Client agrees to verify the accuracy of these time slots and to be present if that delivery method was selected or if required by the hotel.
The Enjoy representative will text or WhatsApp the client when en route and upon arrival at the lobby or vacation home entrance. A 15-minute grace period will be observed; otherwise, the representative will leave to avoid delays. A $30 fee will be charged for lateness. Rescheduling depends on availability.

  • The Client agrees to the following conditions regarding delivery and pickup:
  • If paying in cash, the Client must meet the Enjoy representative in person within the chosen time slot.
  • If staying at a Disney hotel, the Client must meet the representative in person. If prepaid with a card, and staying at a hotel/vacation rental, the item can be left at reception before arrival. For returns, the item may be left at the hotel’s stroller area or reception with prior notice and a photo sent to Enjoy.

The Client also agrees and understands that only the times listed on the web site at www.enjoystrollerrental.com are available for the places of delivery/pick-elected, and that at other times are not available unless you make exceptions and specific arrangements through Enjoy Stroller Rental by e-mail.
The Client accepts and understands that any request for amendment of the existing reservation must be made at least 24 hours in advance at the time of delivery agreed in the booking. Change requests made with less than 24 hours before the time agreed delivery will be fulfilled at the discretion of Enjoy.
The Client agrees and understands that all deliveries are made with great effort at the time of delivery requested, but due to the traffic or the volume, the Client understands that Enjoy to be delivered within the time slot of an hour, that the Client has chosen at the time of booking. The Client understands and agrees that, during times of extreme weather, deliveries and/or pickups can be temporarily suspended for the safety of the delivery staff up to management to consider it safe to continue with the operations (the extreme weather conditions may include, among others, the following: tropical Storms/hurricanes, tornado warnings, winds exceeding 25 mph).
The Customer accepts that if there is no contact within 24-hours prior to the agreed delivery date, the Customer accepts the possession of the rental items and their responsibilities during the possession.
The Client accepts that any reserve may be modified or terminated at any time at the discretion of Enjoy if the desired location is not found in the area of delivery as indicated. The Client understands that any rental item returned to a location outside the designated delivery area may be subject to a retrieval fee or considered a breach of contract.
If the Client has traveled outside the designated delivery/pickup area and cannot return the items in person, it is the Client's responsibility to ensure that all rented equipment and associated items are returned to Enjoy by the original return date via taxi, rideshare, courier, or shipping service (e.g., FedEx, UPS, USPS).
The Client accepts that any reserve may be modified or terminated at the discretion of Enjoy if you Enjoy it considers that the health and safety standards of the hotel, resort or vacation homes desired (place of delivery or pickup) are harmful to the nature of our business.
Customer agrees to maintain possession of the rental item during the course of your rental period. The rental items should be kept secure when not in use (i.e., hotel room, vehicle). During the rental period, the items must not be left in the reception room or luggage for daily storage, unless the request of the hotel, in that case, the Customer undertakes to inform you to Enjoy. The items found in the lobby or rooms of baggage may be considered abandoned or returned ahead of time and are subject to be picked up.
The Customer agrees to report immediately to Enjoy from any defect or malfunction of the article rented during use. Once notified, Enjoy will do everything possible to solve the problem in a timely manner.
In case the rented item fails or breaks due to misuse, and the Client has not opted for the Damage and Theft Waiver, the Client shall be responsible for paying for the damages caused.
The Client agrees to use the rental item solely for its intended purpose. At no time should the established weight limits for the rental items be exceeded.
The Client agrees that violations of this agreement may result in termination of rental. Enjoy reserves the right to terminate a lease on the basis of the evidence of abuse or violation of any and all parts of this agreement. The customer agrees to deliver to each and all of the accessories and equipment rented to Enjoy at the request of Enjoy.
The Customer agrees that, upon request of the customer, any change to the stroller due to (but not limited to): buggy stopped in the rain, vomiting, child, diaper, dripping, or other body fluid,
as it can be (but not limited to): vomiting child, diaper, dripping, or other body fluid, food remains that destroy the fabric of the stroller, excess glitter/glitter/makeup that hinder the cleaning of the future from the cloth of the item rented.

To return the item rented

Resort or hotel that doesn'T belong to Disney Resorts or Hotels Not Affiliated with Disney: It is the Client's responsibility to ensure that all rental items are available for pickup at the hotel or resort at the date and time specified in the reservation. All items can either be returned in person to the Enjoy representative or left at the hotel reception or stroller area, provided a photo is sent to Enjoy beforehand to help the team locate the items during pickup. At no time should any rental item be left inside the guest room after check-out. Items left in the room will incur a $30 retrieval fee.

House or Apartment vacation rental: If the Client wishes to pay in cash and is staying at a vacation home or apartment, it is the Client’s responsibility to be available at the agreed time and location for the delivery of the rented item. If the Client has prepaid with a credit or debit card, the Enjoy representative may leave the rented item at the door of the vacation home or apartment and send the Client a photo of the delivery. Additionally, the Enjoy representative will send the Client an instructional video for the rented item.

Resorts property of Disney: We will need to meet in person for delivery and pickup if you are staying at any of the following Disney Resorts: All-Star Music, All-Star Sports, All-Star Movies, Art of Animation, Pop Century, Caribbean Beach, Riviera, Old Key West, Saratoga Springs, Port Orleans – French Quarter, Port Orleans – Riverside, Fort Wilderness, Wilderness Lodge, Contemporary, Bay Lake Tower, Grand Floridian, Polynesian Village, Beach Club, BoardWalk, and Yacht Club.
At no time should any rental item be left in the guest room after check-out. Rental items left in the rooms will incur a $30 retrieval fee. The Client is 100% responsible for ensuring that the items are available in the stroller area or at the reception for pickup.
The customer agrees to get in touch with Enjoy in case of delay in the return of the rental items at the agreed time. It is at the sole discretion of Enjoy if you can grant a grace period.
You can apply a flat rate of $30 for return trips to pick up rental items if they are not returned within the time agreed upon as indicated in the booking and / or rental is agreed previously with Enjoy.
If the Customer does not deliver the product to you rented without giving notice to Enjoy will be charged a Fee of $100 for each day of delay, up to the amount equivalent to the value of the product rented.

Extension of the rental period

If the Customer wishes to extend the rental period, the Customer must contact Enjoy before the time of return agreed upon. Enjoy may, at its own discretion, to allow or deny any extension. Enjoy reserves the right to charge the card of the Client and the Client agrees to allow the charge of

Item Exchange

Model changes are not allowed unless requested at least 24 hours in advance of the scheduled delivery time slot. It will be at Enjoy’s discretion to accept or deny such a change. If accepted, the Client must make a new reservation and pay the difference.
If the client requires the change of the stroller once it has been delivered, for any of the following or similar reasons: wet from rain, dirt, etc., it will be subject to availability and will have a value of $50 additional to the rental.

Damage or Loss of the Equipment

The Client will accept for use, as is, the rental items listed in the reservation, and accept full responsibility for the care of the equipment while it is in the possession of the Customer.
The Customer is responsible to pay the full value of the replacement of any items rented under this Agreement that is not returned to Enjoy within 48 hours of the end of the agreement.
The Client also agrees to pay the replacement cost for any rental item that is not returned.
The Customer is responsible for paying the cost of replacement of any part or accessory lost, either paid or provided free of charge. These include, but are not limited to: harnesses, protective against the rain, wheels, hoods, storage baskets, cup holders, trays, front, storage locations plastics, etc
The Customer is responsible for the loss, theft, damage or destruction of the rental items, and agree to pay the full replacement value of the rental items to the market value at the time of its replacement.
The Customer agrees to return the rental items in the same conditions in which they were delivered and report immediately to Enjoy for any loss, theft, damage or destruction of the rental items.
The only exception will be if the Client has included the Damage and Loss Waiver in their reservation. The Client may not purchase the Damage and Loss Waiver after the rented item has been delivered by the Enjoy representative.

Transfer or Refund of the Reservation

Reservations are non-transferable. The reservation holder will be responsible for the rented stroller during the entire period in which he/she has it in his/her possession.
When the customer has paid in advance and needs to cancel the reservation, no refund of the amount paid will be provided, but the credit will be maintained for 6 (six) months so that it can be used another time with any of our items.
Once the stroller is delivered to the customer, no refunds will be made.

Cancellation of Booking

Reservations may be canceled up to 24 hours before the scheduled delivery time slot. No refunds will be issued for prepaid reservations that are canceled. In such cases, the Client will receive a credit in the same amount, valid for up to 12 months from the original reservation date. If the Client wishes to cancel a reservation that has not been paid, no payment will be required unless notice is given less than 24 hours in advance. In that case, Enjoy may charge a $30 fee for late cancellation.

Disclaimer

By accepting and using the rental equipment, the Customer and any user acknowledges that the rental equipment is used at your own risk. Enjoy hereby provides no warranty with respect to rental equipment, and Enjoy specifically disclaims all warranties, either express or implied.
Enjoy and their employees, owners and affiliates will not be responsible for accident, injury or damage caused directly or indirectly by the use, misuse, or use of the rental equipment.
The Client and any user agree to hold harmless from liability to Enjoy and its employees, owners, and affiliates, from any and all liability, injury, death, property loss or damages that may result direct or indirectly from the use of the rental equipment.

This Agreement is governed by the laws of the State of Florida.

Contrato de Alquiler de Mobility Scooter – Términos y Condiciones

REYNOSO & DUVAL LLC – DBA Enjoy Stroller Rental

El presente Contrato se celebra entre usted (en adelante, el “Cliente”) y Reynoso & Duval LLC, DBA Enjoy Stroller Rental (en adelante, “Enjoy”). Enjoy sigue siendo el único propietario de todos los equipos de alquiler. A los efectos del presente Contrato, el término “Equipo” incluye el mobility scooter y todos sus accesorios, incluyendo la(s) batería(s), el cargador y la llave. Enjoy no está ofreciendo a la venta, y el Cliente no está comprando el Equipo. El Cliente reconoce que el Equipo será destinado exclusivamente para uso personal y no comercial. Al firmar y aceptar los términos y condiciones del presente Contrato de alquiler, el Cliente declara haber leído, comprendido y aceptado íntegramente todas las disposiciones aquí establecidas.

1. Condiciones generales de alquiler
Todo el Equipo (mobility scooter, cargador, batería(s) y llave) debe ser devuelto en la fecha y horario especificados en la reserva. Si necesitas extender el período de alquiler, debes contactarnos antes de la fecha de finalización al:

El Cliente se compromete a devolver el Equipo en las mismas condiciones en que fue entregado, considerando el uso normal. Enjoy Stroller Rental se reserva el derecho de retirar el Equipo sin previo aviso si se detecta un uso inapropiado o una violación de estos términos.

2. Responsabilidad del usuario
El Cliente asume todos los riesgos asociados al uso del mobility scooter, incluyendo cualquier lesión, daño o pérdida que pueda ocurrir al usuario o a terceros durante el período de alquiler.
Al aceptar estos términos, el Cliente reconoce que:
● El uso del equipo es bajo su propia responsabilidad.
● El scooter debe ser operado de manera prudente y segura.
● El scooter está diseñado para una sola persona.
● No se permite llevar pasajeros adicionales.
● El Cliente debe respetar todas las normas de seguridad aplicables.
El scooter debe ser utilizado únicamente por personas mayores de 18 años. El usuario principal deberá ser el titular de la reserva.
El Cliente acepta no operar el equipo bajo la influencia de alcohol, drogas o medicamentos que puedan afectar su capacidad de manejo seguro.

3. Uso adecuado del equipo
Para garantizar un uso seguro:
● El scooter debe ser utilizado por una sola persona en todo momento.
● Operar siempre a una velocidad moderada y segura (hasta nivel 4).
● Reducir la velocidad en espacios cerrados, áreas concurridas o superficies irregulares.
● No realizar giros bruscos a alta velocidad.
● No subir ni bajar escaleras o escaleras mecánicas con el equipo.
● No circular sobre bordillos, escalones u obstáculos elevados.
● No remolcar objetos, cochecitos u otros dispositivos.
● Mantener brazos y piernas dentro del scooter durante su uso.
● Apagar el scooter cuando no esté en uso.
● Retirar la llave cuando el equipo quede desatendido.
● Guardar la llave en un lugar seguro durante todo el periodo de alquiler.
● No utilizar el equipo si no se siente seguro de poder operarlo correctamente.
El Cliente debe seguir todas las recomendaciones de seguridad proporcionadas por Enjoy Stroller Rental.

4. Uso en condiciones climáticas
El mobility scooter puede utilizarse bajo lluvia ligera únicamente si se utiliza protección adecuada.

Recomendamos el uso de:
● Poncho de lluvia que también cubra el scooter, o Cobertor impermeable para el equipo.
El Cliente deberá utilizar una protección adecuada contra la lluvia, la cual podrá ser provista por el propio Cliente o agregada como accesorio opcional en la reserva.
El Cliente debe evitar conducir el equipo a través de agua profunda o bajo lluvia intensa.
El daño causado por exposición excesiva al agua puede generar cargos de reparación.
El Cliente asume la responsabilidad por cualquier daño ocasionado al equipo por exposición excesiva al agua o por no utilizar la protección adecuada.

5. Daños, pérdida o robo
El Cliente debe reportar inmediatamente cualquier:
● Daño.
● Mal funcionamiento.
● Pérdida.
● Robo.
● Accidente.

El Cliente será responsable por el costo de reparación o reemplazo del equipo en caso de:
● Daño por uso indebido.
● Negligencia.
● Pérdida.
● Robo.
● No devolución del equipo.

Si el equipo no es devuelto dentro de las 24 horas posteriores al horario acordado, el Cliente podrá ser responsable por el valor total de reemplazo del equipo a precio de mercado.

6. Batería y carga
El Equipo incluye al menos una batería y un cargador.
Para un funcionamiento adecuado:
● Cargar la batería completamente durante la noche.
● No dejar que la batería se descargue completamente.
● Utilizar únicamente el cargador provisto.
● Mantener el cargador en un lugar seco.
● Evitar mojar la batería o los componentes eléctricos.
La duración de la batería puede variar según:
● Peso del usuario
● Terreno
● Velocidad
● Uso continuo

Se recomienda cargar el equipo diariamente para evitar interrupciones durante el uso.
El Cliente podrá agregar a su reserva una batería adicional como accesorio opcional, por un costo de $50 por latotalidad del período de alquiler, lo que permitirá aumentar la autonomía del scooter. Se entregará un solo cargador, el cual será compatible con todas las baterías incluidas en la reserva.

7. Limitación de responsabilidad
REYNOSO & DUVAL LLC – DBA Enjoy Stroller Rental no será responsable por daños directos o indirectos derivados del uso del equipo.
El Cliente acepta liberar, defender e indemnizar a la empresa frente a cualquier reclamo, demanda, daño, costo o gasto que surja del uso del mobility scooter durante el período de alquiler.
El Cliente reconoce que el uso del equipo implica riesgos inherentes y acepta asumir dichos riesgos voluntariamente.
Al aceptar y utilizar el equipo de alquiler, el Cliente y cualquier usuario reconocen que el equipo de alquiler se utiliza bajo su propio riesgo. Enjoy no ofrece garantías de ningún tipo respecto del equipo, ya sean expresas o implícitas, incluyendo, sin limitación, garantías de funcionamiento continuo o adecuación para un propósito particular.
Enjoy and their employees, owners and affiliates will not be responsible for accident, injury or damage caused directly or indirectly by the use, misuse, or use of the rental equipment.
El Cliente y cualquier usuario acuerdan eximir de responsabilidad a Enjoy y sus empleados, propietarios y afiliados, de cualquier responsabilidad, lesión, muerte, pérdida de propiedad o daño que pueda resultar directa o indirectamente del uso del equipo de alquiler.

8. Aceptación de los términos
Al completar la reserva, el Cliente confirma que ha leído, entendido y aceptado estos términos y condiciones.

9. Cargos por pérdida o daño del equipo
● Pérdida de llaves: $100
● Pérdida o rotura del cargador: $100
● Daños en el equipo (incluyendo panel de control, batería u otros componentes) ocasionados por
exposición a la lluvia u otros líquidos: $200
● Daños en el equipo ocasionados por choques, golpes o uso inadecuado: $200
Estos cargos se aplicarán únicamente en caso de pérdida o daño atribuible al uso indebido, negligencia o falta de cuidado razonable por parte del Cliente. Cuando el equipo es utilizado de forma responsable, siguiendo las recomendaciones de uso y cuidando adecuadamente todos sus componentes, no se aplicará ningún cargo adicional.

Este Acuerdo se regirá de conformidad con las leyes del Estado de Florida.

 

Aplicabilidad de los Términos

Estos Términos y Condiciones contienen disposiciones separadas aplicables a los distintos productos de alquiler ofrecidos por Enjoy Stroller Rental, incluyendo:
Sección I: Contrato de Alquiler y Exención de Responsabilidad para Cochecitos (Stroller Rental Agreement and Liability Waiver)
Sección II: Contrato de Alquiler de Scooters de Movilidad – Términos y Condiciones (Mobility Scooter Rental Agreement – Terms and Conditions)
Los términos aplicables al Cliente dependerán del producto alquilado:
● Si el Cliente alquila únicamente un cochecito o accesorios relacionados, será aplicable únicamente la Sección I (Contrato de Alquiler y Exención de Responsabilidad para Cochecitos).
● Si el Cliente alquila únicamente un scooter de movilidad o accesorios relacionados, será aplicable únicamente la Sección II (Contrato de Alquiler de Scooters de Movilidad – Términos y Condiciones).
● Si el Cliente alquila tanto un cochecito como un scooter de movilidad dentro de una misma reserva o reservas relacionadas, serán aplicables ambas Secciones (I y II), y el Cliente acepta cumplir con todas las obligaciones, responsabilidades, exenciones y disposiciones sobre responsabilidad contenidas en ambas.
Al completar una reserva, el Cliente reconoce y acepta quedar sujeto a la(s) sección(es) que correspondan según el equipamiento alquilado.
En caso de alquiler de múltiples productos, estas disposiciones se interpretarán de manera acumulativa y no alternativa.
