Enjoy remains the sole owner of all rental equipment. Enjoy is not offering \nthe equipment for sale, and the Client is not purchasing it. The Client hereby acknowledges \nthat the equipment is for personal use only. By signing and accepting the terms and \nconditions of this rental agreement, the Client acknowledges having read, understood, and \naccepted the terms set forth below.<br \/><\/span><\/p><p style=\"text-align: left;\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"text-decoration: underline;\"><b>Reservations and payment of rental fees<\/b><\/span><\/p><p style=\"font-weight: 400;\">All reservations are made through the website www.enjoystrollerrental.com. To do so, the \nclient must enter: name of lodging plus delivery address, name of lodging plus pick-up \naddress, delivery time window, and pick-up time window.<br \/>We accept reservations at least 24 hours in advance; otherwise, the client may check with \nEnjoy for stock and service availability. \u201cService\u201d refers to the delivery and pick-up of rented \nitems.<br \/>Payment must be made by credit\/debit card via a payment link sent to the client once the \nreservation is completed. Payment must be completed no later than the moment of delivery \nif in-person. If not in-person, payment must be completed by the day prior to the delivery \ndate.<br \/>The client will automatically receive a confirmation email after completing the reservation. \nThe reservation will only be considered completed once the client receives the Order \nNumber; otherwise, the reservation is not valid. Product colors may vary from those shown \nin pictures.<\/p><p><span style=\"text-decoration: underline;\"><b>Delivery, Possession and Use<\/b><\/span><\/p><p style=\"font-weight: 400;\">The Client understands that delivery and pickup are based on addresses within a 15-mile \nradius of Walt Disney World. Addresses outside this radius are not serviced by Enjoy. \nHowever, a meeting point may be arranged by the company.<br \/>The Client understands that Enjoy only delivers and picks up at the lodging entered in the \nreservation. Deliveries and pickups are not made at other locations.<br \/>The Client agrees to verify that the lodging name and\/or delivery and pickup addresses are \ncorrect. If the Enjoy representative goes to the address listed in the reservation and it is \nincorrect, a $30 fee will be charged for the failed attempt. The representative may proceed to \nthe correct address only if the schedule allows. Correctly submitted reservations take \nscheduling priority.<br \/>Our service hours are between 7:00 a.m. and 7:00 p.m., with one-hour time slots.<br \/>The Client understands that delivery\/pickup will be made within the selected one-hour time \nslot. The Client agrees to verify the accuracy of these time slots and to be present if that \ndelivery method was selected or if required by the hotel.<br \/>The Enjoy representative will text or WhatsApp the client when en route and upon arrival at \nthe lobby or vacation home entrance. A 15-minute grace period will be observed; otherwise, \nthe representative will leave to avoid delays. A $30 fee will be charged for lateness. \nRescheduling depends on availability.<\/p><ul><li>The Client agrees to the following conditions regarding delivery and pickup:<\/li><li>If paying in cash, the Client must meet the Enjoy representative in person within the \nchosen time slot.<\/li><li>If staying at a Disney hotel, the Client must meet the representative in person.\n\nIf prepaid with a card, and staying at a hotel\/vacation rental, the item can be left at \nreception before arrival. For returns, the item may be left at the hotel\u2019s stroller area or \nreception with prior notice and a photo sent to Enjoy.<\/li><\/ul><p style=\"font-weight: 400;\">The Client also agrees and understands that only the times listed on the web site at <i>www.enjoystrollerrental.com<\/i> are available for the places of delivery\/pick-elected, and that at other times are not available unless you make exceptions and specific arrangements through Enjoy Stroller Rental by e-mail.<br \/>The Client accepts and understands that any request for amendment of the existing reservation must be made at least 24 hours in advance at the time of delivery agreed in the booking. Change requests made with less than 24 hours before the time agreed delivery will be fulfilled at the discretion of Enjoy.<br \/>The Client agrees and understands that all deliveries are made with great effort at the time of delivery requested, but due to the traffic or the volume, the Client understands that Enjoy to be delivered within the time slot of an hour, that the Client has chosen at the time of booking. The Client understands and agrees that, during times of extreme weather, deliveries and\/or pickups can be temporarily suspended for the safety of the delivery staff up to management to consider it safe to continue with the operations (the extreme weather conditions may include, among others, the following: tropical Storms\/hurricanes, tornado warnings, winds exceeding 25 mph).<br \/>The Customer accepts that if there is no contact within 24-hours prior to the agreed delivery date, the Customer accepts the possession of the rental items and their responsibilities during the possession.<br \/>The Client accepts that any reserve may be modified or terminated at any time at the discretion of Enjoy if the desired location is not found in the area of delivery as indicated. The Client understands that any rental item returned to a location outside the designated delivery area may be subject to a retrieval fee or considered a breach of contract.<br \/>If the Client has traveled outside the designated delivery\/pickup area and cannot return the items in person, it is the Client's responsibility to ensure that all rented equipment and associated items are returned to Enjoy by the original return date via taxi, rideshare, courier, or shipping service (e.g., FedEx, UPS, USPS).<br \/>The Client accepts that any reserve may be modified or terminated at the discretion of Enjoy if you Enjoy it considers that the health and safety standards of the hotel, resort or vacation homes desired (place of delivery or pickup) are harmful to the nature of our business.<br \/>Customer agrees to maintain possession of the rental item during the course of your rental period. The rental items should be kept secure when not in use (i.e., hotel room, vehicle). During the rental period, the items must not be left in the reception room or luggage for daily storage, unless the request of the hotel, in that case, the Customer undertakes to inform you to Enjoy. The items found in the lobby or rooms of baggage may be considered abandoned or returned ahead of time and are subject to be picked up.<br \/>The Customer agrees to report immediately to Enjoy from any defect or malfunction of the article rented during use. Once notified, Enjoy will do everything possible to solve the problem in a timely manner.<br \/>In case the rented item fails or breaks due to misuse, and the Client has not opted for the Damage and Theft Waiver, the Client shall be responsible for paying for the damages caused.<br \/>The Client agrees to use the rental item solely for its intended purpose. At no time should the established weight limits for the rental items be exceeded.<br \/>The Client agrees that violations of this agreement may result in termination of rental. Enjoy reserves the right to terminate a lease on the basis of the evidence of abuse or violation of any and all parts of this agreement. The customer agrees to deliver to each and all of the accessories and equipment rented to Enjoy at the request of Enjoy.<br \/>The Customer agrees that, upon request of the customer, any change to the stroller due to (but not limited to): buggy stopped in the rain, vomiting, child, diaper, dripping, or other body fluid,<br \/>as it can be (but not limited to): vomiting child, diaper, dripping, or other body fluid, food remains that destroy the fabric of the stroller, excess glitter\/glitter\/makeup that hinder the cleaning of the future from the cloth of the item rented.<\/p><p><span style=\"text-decoration: underline;\"><b>To return the item rented<\/b><\/span><\/p><p style=\"font-weight: 400;\"><b>Resort or hotel that doesn&#039;T belong to Disney<\/b> Resorts or Hotels Not Affiliated with Disney:\n\nIt is the Client's responsibility to ensure that all rental items are available for pickup at the hotel or resort at the date and time specified in the reservation. All items can either be returned in person to the Enjoy representative or left at the hotel reception or stroller area, provided a photo is sent to Enjoy beforehand to help the team locate the items during pickup.\n\nAt no time should any rental item be left inside the guest room after check-out. Items left in the room will incur a $30 retrieval fee.<\/p><p style=\"font-weight: 400;\">At no time should any rental item be left in the guest room after check-out. Rental items left in the rooms will incur a $30 retrieval fee. The Client is 100% responsible for ensuring that the items are available in the stroller area or at the reception for pickup.<\/p><p style=\"font-weight: 400;\"><b>House or Apartment vacation rental:<\/b> If the Client wishes to pay in cash and is staying at a vacation home or apartment, it is the Client\u2019s responsibility to be available at the agreed time and location for the delivery of the rented item. If the Client has prepaid with a credit or debit card, the Enjoy representative may leave the rented item at the door of the vacation home or apartment and send the Client a photo of the delivery. Additionally, the Enjoy representative will send the Client an instructional video for the rented item.<\/p><p style=\"font-weight: 400;\"><b>Resorts property of Disney:<\/b> We will need to meet in person for delivery and pickup if you are staying at any of the following Disney Resorts:\nAll-Star Music, All-Star Sports, All-Star Movies, Art of Animation, Pop Century, Caribbean Beach, Riviera, Old Key West, Saratoga Springs, Port Orleans \u2013 French Quarter, Port Orleans \u2013 Riverside, Fort Wilderness, Wilderness Lodge, Contemporary, Bay Lake Tower, Grand Floridian, Polynesian Village, Beach Club, BoardWalk, and Yacht Club.<br \/>At no time should any rental item be left in the guest room after check-out. Rental items left in the rooms will incur a $30 retrieval fee. The Client is 100% responsible for ensuring that the items are available in the stroller area or at the reception for pickup.<br \/>The customer agrees to get in touch with Enjoy in case of delay in the return of the rental items at the agreed time. It is at the sole discretion of Enjoy if you can grant a grace period.<br \/>You can apply a flat rate of $30 for return trips to pick up rental items if they are not returned within the time agreed upon as indicated in the booking and \/ or rental is agreed previously with Enjoy.<br \/>If the Customer does not deliver the product to you rented without giving notice to Enjoy will be charged a Fee of $100 for each day of delay, up to the amount equivalent to the value of the product rented.<\/p><p><span style=\"text-decoration: underline;\"><b>Extension of the rental period<\/b><\/span><\/p><p style=\"font-weight: 400;\">If the Customer wishes to extend the rental period, the Customer must contact Enjoy before the time of return agreed upon. Enjoy may, at its own discretion, to allow or deny any extension. Enjoy reserves the right to charge the card of the Client and the Client agrees to allow the charge of<\/p><p><span style=\"text-decoration: underline;\"><b>Item Exchange<\/b><\/span><\/p><p style=\"font-weight: 400;\">Model changes are not allowed unless requested at least 24 hours in advance of the scheduled delivery time slot. It will be at Enjoy\u2019s discretion to accept or deny such a change. If accepted, the Client must make a new reservation and pay the difference.<br \/>If the client requires the change of the stroller once it has been delivered, for any of the following or similar reasons: wet from rain, dirt, etc., it will be subject to availability and will have a value of $50 additional to the rental.<\/p><p><span style=\"text-decoration: underline;\"><b>Damage or Loss of the Equipment<\/b><\/span><\/p><p style=\"font-weight: 400;\">The Client will accept for use, as is, the rental items listed in the reservation, and accept full responsibility for the care of the equipment while it is in the possession of the Customer.<br \/>The Customer is responsible to pay the full value of the replacement of any items rented under this Agreement that is not returned to Enjoy within 48 hours of the end of the agreement.<br \/>The Client also agrees to pay the replacement cost for any rental item that is not returned.<br \/>The Customer is responsible for paying the cost of replacement of any part or accessory lost, either paid or provided free of charge. These include, but are not limited to: harnesses, protective against the rain, wheels, hoods, storage baskets, cup holders, trays, front, storage locations plastics, etc<br \/>The Customer is responsible for the loss, theft, damage or destruction of the rental items, and agree to pay the full replacement value of the rental items to the market value at the time of its replacement.<br \/>The Customer agrees to return the rental items in the same conditions in which they were delivered and report immediately to Enjoy for any loss, theft, damage or destruction of the rental items.<br \/>The only exception will be if the Client has included the Damage and Loss Waiver in their reservation. The Client may not purchase the Damage and Loss Waiver after the rented item has been delivered by the Enjoy representative.<\/p><p><span style=\"text-decoration: underline;\"><b>Transfer or Refund of the Reservation<\/b><\/span><\/p><p style=\"font-weight: 400;\">Reservations are non-transferable. The reservation holder will be responsible for the rented stroller during the entire period in which he\/she has it in his\/her possession.<br \/>When the customer has paid in advance and needs to cancel the reservation, no refund of the amount paid will be provided, but the credit will be maintained for 6 (six) months so that it can be used another time with any of our items.<br \/>Once the stroller is delivered to the customer, no refunds will be made.<\/p><p><span style=\"text-decoration: underline;\"><b>Cancellation of Booking<\/b><\/span><\/p><p style=\"font-weight: 400;\">Reservations may be canceled up to 24 hours before the scheduled delivery time slot. No refunds will be issued for prepaid reservations that are canceled. In such cases, the Client will receive a credit in the same amount, valid for up to 12 months from the original reservation date. If the Client wishes to cancel a reservation that has not been paid, no payment will be required unless notice is given less than 24 hours in advance. In that case, Enjoy may charge a $30 fee for late cancellation.<\/p><p><span style=\"text-decoration: underline;\"><b>Disclaimer<\/b><\/span><\/p><p style=\"font-weight: 400;\">By accepting and using the rental equipment, the Customer and any user acknowledges that the rental equipment is used at your own risk. Enjoy hereby provides no warranty with respect to rental equipment, and Enjoy specifically disclaims all warranties, either express or implied.<br \/>Enjoy and their employees, owners and affiliates will not be responsible for accident, injury or damage caused directly or indirectly by the use, misuse, or use of the rental equipment.<br \/>The Client and any user agree to hold harmless from liability to Enjoy and its employees, owners, and affiliates, from any and all liability, injury, death, property loss or damages that may result direct or indirectly from the use of the rental equipment.<\/p><p><span style=\"text-decoration: underline;\"><strong>This Agreement is governed by the laws of the State of Florida.<\/strong><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f415e83 elementor-widget elementor-widget-text-editor\" data-id=\"f415e83\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h1><span style=\"color: #800080;\">Contrato<strong> de Alquiler de Mobility Scooter \u2013 T\u00e9rminos y Condiciones<\/strong><\/span><\/h1><p>REYNOSO &amp; DUVAL LLC \u2013 DBA Enjoy Stroller Rental<\/p><p>El presente Contrato se celebra entre usted (en adelante, el \u201cCliente\u201d) y Reynoso &amp; Duval LLC, DBA Enjoy Stroller Rental (en adelante, \u201cEnjoy\u201d). Enjoy sigue siendo el \u00fanico propietario de todos los equipos de alquiler. A los efectos del presente Contrato, el t\u00e9rmino \u201cEquipo\u201d incluye el mobility scooter y todos sus accesorios, incluyendo la(s) bater\u00eda(s), el cargador y la llave. Enjoy no est\u00e1 ofreciendo a la venta, y el Cliente no est\u00e1 comprando el Equipo. El Cliente reconoce que el Equipo ser\u00e1 destinado exclusivamente para uso personal y no comercial. Enjoy Stroller Rental se reserva el derecho de retirar el Equipo sin previo aviso si se detecta un uso inapropiado o una violaci\u00f3n de estos t\u00e9rminos.<\/p><p>2. Responsabilidad del usuario<br \/>El Cliente asume todos los riesgos asociados al uso del mobility scooter, incluyendo cualquier lesi\u00f3n, da\u00f1o o p\u00e9rdida que pueda ocurrir al usuario o a terceros durante el per\u00edodo de alquiler.<br \/>Al aceptar estos t\u00e9rminos, el Cliente reconoce que:<br \/>\u25cf El uso del equipo es bajo su propia responsabilidad.<br \/>\u25cf El scooter debe ser operado de manera prudente y segura.<br \/>\u25cf El scooter est\u00e1 dise\u00f1ado para una sola persona.<br \/>\u25cf No se permite llevar pasajeros adicionales.<br \/>\u25cf El Cliente debe respetar todas las normas de seguridad aplicables.<br \/>El scooter debe ser utilizado \u00fanicamente por personas mayores de 18 a\u00f1os. El usuario principal deber\u00e1 ser el titular de la reserva.<br \/>El Cliente acepta no operar el equipo bajo la influencia de alcohol, drogas o medicamentos que puedan afectar su capacidad de manejo seguro.<\/p><p>3. Uso adecuado del equipo<br \/>Para garantizar un uso seguro:<br \/>\u25cf El scooter debe ser utilizado por una sola persona en todo momento.<br \/>\u25cf Operar siempre a una velocidad moderada y segura (hasta nivel 4).<br \/>\u25cf Reducir la velocidad en espacios cerrados, \u00e1reas concurridas o superficies irregulares.<br \/>\u25cf No realizar giros bruscos a alta velocidad.<br \/>\u25cf No subir ni bajar escaleras o escaleras mec\u00e1nicas con el equipo.<br \/>\u25cf No circular sobre bordillos, escalones u obst\u00e1culos elevados.<br \/>\u25cf No remolcar objetos, cochecitos u otros dispositivos.<br \/>\u25cf Mantener brazos y piernas dentro del scooter durante su uso.<br \/>\u25cf Apagar el scooter cuando no est\u00e9 en uso.<br \/>\u25cf Retirar la llave cuando el equipo quede desatendido.<br \/>\u25cf Guardar la llave en un lugar seguro durante todo el periodo de alquiler.<br \/>\u25cf No utilizar el equipo si no se siente seguro de poder operarlo correctamente.<br \/>El Cliente debe seguir todas las recomendaciones de seguridad proporcionadas por Enjoy Stroller Rental.<\/p><p>4. Uso en condiciones clim\u00e1ticas<br \/>El mobility scooter puede utilizarse bajo lluvia ligera \u00fanicamente si se utiliza protecci\u00f3n adecuada.<\/p><p>Recomendamos el uso de:<br \/>\u25cf Poncho de lluvia que tambi\u00e9n cubra el scooter, o Cobertor impermeable para el equipo.<br \/>El Cliente deber\u00e1 utilizar una protecci\u00f3n adecuada contra la lluvia, la cual podr\u00e1 ser provista por el propio Cliente o agregada como accesorio opcional en la reserva.<br \/>El Cliente debe evitar conducir el equipo a trav\u00e9s de agua profunda o bajo lluvia intensa.<br \/>El da\u00f1o causado por exposici\u00f3n excesiva al agua puede generar cargos de reparaci\u00f3n.<br \/>El Cliente asume la responsabilidad por cualquier da\u00f1o ocasionado al equipo por exposici\u00f3n excesiva al agua o por no utilizar la protecci\u00f3n adecuada.<\/p><p>5. Bater\u00eda y carga<br \/>El Equipo incluye al menos una bater\u00eda y un cargador.<br \/>Para un funcionamiento adecuado:<br \/>\u25cf Cargar la bater\u00eda completamente durante la noche.<br \/>\u25cf No dejar que la bater\u00eda se descargue completamente.<br \/>\u25cf Utilizar \u00fanicamente el cargador provisto.<br \/>\u25cf Mantener el cargador en un lugar seco.<br \/>\u25cf Evitar mojar la bater\u00eda o los componentes el\u00e9ctricos.<br \/>La duraci\u00f3n de la bater\u00eda puede variar seg\u00fan:<br \/>\u25cf Peso del usuario<br \/>\u25cf Terreno<br \/>\u25cf Velocidad<br \/>\u25cf Uso continuo<\/p><p>Se recomienda cargar el equipo diariamente para evitar interrupciones durante el uso.<br \/>El Cliente podr\u00e1 agregar a su reserva una bater\u00eda adicional como accesorio opcional, por un costo de $50 por latotalidad del per\u00edodo de alquiler, lo que permitir\u00e1 aumentar la autonom\u00eda del scooter. Se entregar\u00e1 un solo cargador, el cual ser\u00e1 compatible con todas las bater\u00edas incluidas en la reserva.<\/p><p>7. Limitaci\u00f3n de responsabilidad<br \/>REYNOSO &amp; DUVAL LLC \u2013 DBA Enjoy Stroller Rental no ser\u00e1 responsable por da\u00f1os directos o indirectos derivados del uso del equipo.<br \/>El Cliente acepta liberar, defender e indemnizar a la empresa frente a cualquier reclamo, demanda, da\u00f1o, costo o gasto que surja del uso del mobility scooter durante el per\u00edodo de alquiler.<br \/>El Cliente reconoce que el uso del equipo implica riesgos inherentes y acepta asumir dichos riesgos voluntariamente.<br \/>Al aceptar y utilizar el equipo de alquiler, el Cliente y cualquier usuario reconocen que el equipo de alquiler se utiliza bajo su propio riesgo. Enjoy no ofrece garant\u00edas de ning\u00fan tipo respecto del equipo, ya sean expresas o impl\u00edcitas, incluyendo, sin limitaci\u00f3n, garant\u00edas de funcionamiento continuo o adecuaci\u00f3n para un prop\u00f3sito particular.<br \/>Enjoy and their employees, owners and affiliates will not be responsible for accident, injury or damage caused directly or indirectly by the use, misuse, or use of the rental equipment.<br \/>El Cliente y cualquier usuario acuerdan eximir de responsabilidad a Enjoy y sus empleados, propietarios y afiliados, de cualquier responsabilidad, lesi\u00f3n, muerte, p\u00e9rdida de propiedad o da\u00f1o que pueda resultar directa o indirectamente del uso del equipo de alquiler.<\/p><p>8. Aceptaci\u00f3n de los t\u00e9rminos<br \/>Al completar la reserva, el Cliente confirma que ha le\u00eddo, entendido y aceptado estos t\u00e9rminos y condiciones.<\/p><p>9. Cargos por p\u00e9rdida o da\u00f1o del equipo<br \/>\u25cf P\u00e9rdida de llaves: $100<br \/>\u25cf P\u00e9rdida o rotura del cargador: $100<br \/>\u25cf Da\u00f1os en el equipo (incluyendo panel de control, bater\u00eda u otros componentes) ocasionados por<br \/>exposici\u00f3n a la lluvia u otros l\u00edquidos: $200<br \/>\u25cf Da\u00f1os en el equipo ocasionados por choques, golpes o uso inadecuado: $200<br \/>Estos cargos se aplicar\u00e1n \u00fanicamente en caso de p\u00e9rdida o da\u00f1o atribuible al uso indebido, negligencia o falta de cuidado razonable por parte del Cliente. Cuando el equipo es utilizado de forma responsable, siguiendo las recomendaciones de uso y cuidando adecuadamente todos sus componentes, no se aplicar\u00e1 ning\u00fan cargo adicional.<\/p><p>Este Acuerdo se regir\u00e1 de conformidad con las leyes del Estado de Florida.<\/p><p>\u00a0<\/p><h1><strong>Aplicabilidad de los T\u00e9rminos<\/strong><\/h1><p>Estos T\u00e9rminos y Condiciones cochecito o accesorios relacionados, ser\u00e1 aplicable \u00fanicamente la Secci\u00f3n I (Contrato de Alquiler y Exenci\u00f3n de Responsabilidad para Cochecitos).<br \/>\u25cf Si el Cliente alquila \u00fanicamente un scooter de movilidad o accesorios relacionados, ser\u00e1 aplicable \u00fanicamente la Secci\u00f3n II (Contrato de Alquiler de Scooters de Movilidad \u2013 T\u00e9rminos y Condiciones).<br \/>\u25cf Si el Cliente alquila tanto un cochecito como un scooter de movilidad dentro de una misma reserva o reservas relacionadas, ser\u00e1n aplicables ambas Secciones (I y II), y el Cliente acepta cumplir con todas las obligaciones, responsabilidades, exenciones y disposiciones sobre responsabilidad contenidas en ambas.<br \/>Al completar una reserva, el Cliente reconoce y acepta quedar sujeto a la(s) secci\u00f3n(es) que correspondan seg\u00fan el equipamiento alquilado.<br \/>En caso de alquiler de m\u00faltiples productos, estas disposiciones se interpretar\u00e1n de
